• Retainers are billed in advance of the service period
• Advertising spend is separate from management fees and is paid directly by the client to the advertising platform unless otherwise agreed
• Late payments may result in suspension of services

Our Content

All content on this website — including text, graphics, logos, the Stay Entertained Media name and mark, images, and software — is owned by or licensed to SEM and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Client Deliverables

Ownership of creative deliverables produced under a service agreement is governed by that agreement. Unless otherwise specified, ownership transfers to the client upon full payment. SEM retains the right to display work in its portfolio and marketing materials unless the client requests otherwise in writing.

Our services involve third-party advertising and technology platforms including but not limited to Meta, Google, TikTok, and YouTube. Your use of those platforms is subject to their own terms and policies. SEM is not responsible for platform outages, policy changes, account restrictions, ad disapprovals, or changes to platform algorithms or pricing.

THIS WEBSITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Our total aggregate liability arising out of or related to any engagement shall not exceed the amount of fees paid by the client to SEM in the three (3) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Stay Entertained Media from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your violation of any law or third-party right, or content or materials you provide to us.

We reserve the right to suspend or terminate your access to our website at any time, with or without notice, for any reason. Termination of service engagements is governed by the applicable service agreement.

12. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Northwest Arkansas, and you consent to the exclusive jurisdiction of those courts.

13. Changes to These Terms

We may revise these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
